That's why Disney is SO paranoid about it that they sent a cease and desist letter to a nursery school. If they DO NOT, they cannot LEGALLY prevent others from using it. Now, is Disney going to actually SUE the nursery school? Not likely-- but they have legal standing if someone ELSE uses it for purposes they don't like and they DO sue THEM. Since no lawsuit was actually threatened (the man, who is NOT an attorney, only said they RESERVE THE RIGHT to all options, not something similar to 'we will be forced to take legal action,') that is likely the purpose of the letter.
